Important information about deadlines

When you receive a letter from us in which we ask you to correct a deficiency or explain something that is unclear, we set a deadline for when the answer must be sent to us. 

This deadline can vary by a number of months, depending on what we are asking for and where in the process the application is. 

It is very important that you meet our deadlines. This applies both to responding to letters and to paying fees and charges.

If you do not pay or respond within the deadline, the application will be rejected. An application can be dismissed both due to non-payment and if you do not respond.

If you see that you do not have time to respond to our statement with an assessment of your application within the deadline we have given you, you can ask for a deadline extension. You must do so by the end of the original deadline.

This applies to patents:

You get an automatic deadline extension of two (2) months without us giving you feedback, so you have to keep track of the postponed deadline yourself .

You can get an automatic deadline extension two (2) times for one application. If we cannot give you a deadline extension, you will be notified by us.

In completely extraordinary cases, deadline extensions are granted when there are "special reasons".

NB : It is important to note that the possibility of deadline extensions does not apply to letters where we ask you to correct formal deficiencies upon delivery.

Even if you missed the deadline, it is possible to ask us to continue processing the application. You must then rectify the deficiencies and request the resumption of application processing within a specified deadline.

For patent applications, the deadline for doing this is four (4) months from the original deadline.

For trademark and design applications, the deadline is two (2) months from the original deadline.

We then invoice a set fee for resumption for each shelved application. Once the fee has been paid, we will resume your application for further processing. 

If you have forgotten to meet a certain deadline, and this has resulted in you losing an application or a notified/registered right, you can apply to have your application or right restored.

How to request a deadline extension?

Use Altinn (correspondence to the Norwegian Industrial Property Office, NIPO), possibly e-mail or letter to the NIPO, and mark the request "deadline extension".

You can also request an automatic deadline extension by logging in to "My cases".
