What is a trademark?

A trademark can consist of words, letters, numbers, symbols or a combination of these, and is used on products, packaging and in marketing to distinguish the company's goods or services from those of others.

How do I get trademark protection?

To register a trademark, you must submit an application to the Norwegian Industrial Property Office. Before you apply, there are several things you should think through:

  • Your brand must be distinctive, it cannot simply describe the product.
  • Your brand must not be confused with others' trademarks.
  • Your trademark must not be misleading.
  • Your trademark must not contain someone else's name or image.

Et varemerke er et viktig kjennetegn for bedrifter og deres varer eller tjenester. Når du registrerer varemerket ditt, forsikrer du deg om at du får eksklusive rettigheter til å bruke det til de varene og tjenestene du selger.

Ja, i varemerkeregisteret vårt kan du søke etter alle varemerker som er registrert i Norge. 

Ønsker du å finne ut om varemerket er registrert utenfor Norge, må du søke i internasjonale databaser.

Varemerker er kjennetegnet for varen eller tjenesten din, og du registrerer den hos Patentstyret. Foretaksnavn er navnet på selskapet ditt som du registrerer hos Brønnøysundsregisteret. 

Navnesok.no er en søketjeneste hvor du kan sjekke om både domenenavn, foretaksnavn og varemerke er ledig - alle tre i ett søk.

Frequently asked questions about the trademark application

Du betaler et søknadsgebyr for at vi skal behandle søknaden din. En varemerkesøknad koster fra kr 3 800. 

Registreringen varer i 10 år fra søknadsdatoen. Du kan fornye registreringen din hvert 10. år et ubegrenset antall ganger. Fornyelsesavgiften koster fra kr 3 400.

Når du søker om å få registrert et varemerke, må du oppgi hvilke varer og tjenester (produkter) du tenker at varemerket skal brukes på. Alle varer og tjenester er delt inn i et system som består av 45 ulike klasser.

Du kan forvente svar innen 3 uker hvis du betaler ved innlevering av søknaden og bruker forhåndsgodkjente navn på produkter (termer) fra produktvelgeren. 

Behandlingen av lyd-, bevegelses-, multimedia- og hologrammerker kan ta lengre tid.  

Hvis søknaden ikke er betalt ved innlevering, eller du ikke har valgt forhåndsgodkjent varefortegnelse, kan du forvente svar innen 4 måneder etter at vi har mottatt betaling.

Gjennom vårt varemerkeregister kan du sette opp varsling på sak, og du kan lagre søk som følger med på hva konkurrenter gjør.

1. Start med et søk i søketjenesten 
2. Fra trefflisten får du mulighet til å sette opp varsling ved å klikke på «lagre søk» (da setter du opp varsel på hele søket) eller huk av på en eller flere bestemte saker og klikk «følg sak».
